How do I file an uncontested divorce in Texas?
As best as I can recall, if you want to do it yourself, you will have to get the proper forms, file a petition, pay the filing fee, file the petition, let your spouse see the petition, get your spouse to sign a waiver so service isnt necessary; after that, Im not sure. I think you just file the signed, notarized waiver with the court where you filed the petition, and ask for a hearing for an uncontested divorce. The clerk of the District Court where you file the petition should be able to give you some information about that. However I havent done family law in a number of years, so perhaps you need advice from someone whos more up to date than I am. The procedures may have changed.
