In Texas, a man is divorced and paying child support.?
Life insurance goes to the named beneficiary. The parent who purchased the policy was probably the beneficiary. Being the beneficiary of life insurance does not obligate you to pay for a funeral. When the funeral was planned, the funeral home would have been authorized by someone to do the funeral. The person who authorized the funeral is the one who contracted for the services. Lets say that the husband planned the funeral so he paid for it. He might be able to take it to court and ask for half from the wife but if he did anything beyond the bare minimum she could object that she wouldnt have authorized it. If he bought an expensive casket, for example, she could say he could have bought one that was 10% of the cost or simply had the child cremated. If the wife arranged the funeral, she would be the one who authorized the expenses. The husband would not be obligated to pay unless a court ordered him to which would require the wife or funeral home to take him to court.
